Third-degree assault, the least serious, involves physical contact causing injury or pain, with penalties up to 1 year in prison and a $2,000 fine.
Battery charges range from simple battery to more severe forms like sexual battery, battery related to family violence, and aggravated battery. Assault becomes aggravated assault if there is use of a deadly weapon or intent to commit a felony.
The penalties for assault in Connecticut will depend on the type of assault a person is charged with as well as the severity of the victim's injuries. First-degree assault is a felony charge that is punishable by up to 20 years in prison (in some circumstances, carrying a 5-year mandatory minimum) and a fine of up to $15,000. Second-degree assault is also a felony charge and is punishable by up to 5 years in prison and a fine of up to $5,000. Third-degree assault is a misdemeanor charge and is punishable by up to 1 year in prison and a fine of up to $2,000.
There are several possible defenses to assault charges in Connecticut, and the best defense will depend on the individual circumstances of your case. A few possible defenses might include:
Self-defense. You may be able to claim self-defense if you can show that you reasonably believed that you or someone else was in imminent danger of harm and that the use of force was necessary to prevent that harm.
