Types of Drug Charges in Connecticut

There are a few different ways that someone can be charged with a drug crime in the state of Connecticut. The type of charge and the penalties will depend on the specifics of the case, and can range from possession of a small amount of drugs for personal use to trafficking large quantities of drugs. Some common types of drug charges in Connecticut include:

Possession. Possessing a controlled substance without a valid prescription is illegal in Connecticut. The penalties for possession depend on the type and amount of drug involved. Conviction of a possession charge can result in up to a year of jail time and fines for a first offense

Possession with intent to sell. If the police believe that you intended to sell the drugs you were caught with, you could be charged with possession with intent to sell. This is a more serious charge than simple possession, and can result in a mandatory minimum of 5 years and up to 20 years in prison for a first offense for a non-drug dependent person. (There are separate offenses and penalties for a drug dependent person.)

Trafficking. Trafficking is the most serious type of drug charge in Connecticut. If you’re caught selling, manufacturing, or transporting drugs, you could be facing trafficking charges. The penalties for trafficking depend on the type and amount of drug involved, whether the defendant is dependent on drugs, and the defendant’s criminal record. Typically, these penalties are harsher than those for possession or possession with intent to sell. 

Marijuana Charges in Connecticut

With the decriminalization of marijuana in the state of Connecticut, there has come a good amount of confusion about what you can and cannot be penalized for. Possession of under a half ounce of the drug without a marijuana card is an infraction punishable by a fine. You may still be arrested for possession of over a half ounce of marijuana, which is a misdemeanor. The sale of marijuana by someone who is not a licensed dispensary is also treated in the same way as sale of narcotics.
