What is Carjacking?

Carjacking is defined as the unlawful taking of a motor vehicle from the possession of another person by force or threat of force. In order to be convicted of carjacking, there must be proof that the defendant intended to permanently or temporarily deprive the owner of the vehicle of their possession of the vehicle. There are a number of ways that carjacking can occur. For example, someone could forcefully take another person’s keys and then drive off in their car. Or, they could threaten to harm the owner if they do not hand over their car keys. In Connecticut, there are no specific carjacking charges; rather, a person will be charged with larceny (theft) or robbery.

What Can Affect Carjacking Penalties?

As with any criminal charges, so much of the case and defense strategy will depend on the specifics of the circumstances. If convicted, carjacking in Connecticut can earn the accused a three year mandatory minimum of jail time, in addition and consecutive to any imprisonment for the robbery/larceny and other charges.
